The Texas question every owner asks first

More Texas operators call us about card fees than about hardware, and the confusion is legitimate. Texas has a statute on the books prohibiting credit card surcharges, and a federal court has held that statute unconstitutional as applied to merchants. Two true things pointing in opposite directions.

What that means practically is in the next section. What it means commercially is that Texas restaurants have spent years leaving a compliant, well-understood option on the table because nobody sat down and explained it.

Is dual pricing legal in Texas?

Short version: a properly built cash discount or dual pricing program is the route Texas merchants use, and it does not depend on how the surcharge dispute is finally resolved.

Can I charge a credit card fee in Texas?

In practice, yes, through a cash discount or dual pricing program. The state statute banning surcharges has been held unconstitutional as applied to merchants, but rather than rely on that, most Texas businesses use dual pricing, which posts a card price and a lower cash price and never meets the definition of a surcharge.

What is the difference between a surcharge and a cash discount here?

A surcharge starts from the cash price and adds a fee at checkout. A cash discount starts from the card price as the listed price and takes money off for cash. The customer often pays the same either way, but only one of the two runs into the Texas statute.

Do I need to notify anyone before starting dual pricing?

The card networks require written notice before a merchant begins surcharging, and your processor normally files it. Cash discount programs carry lighter requirements but still need clear signage at the point of sale and a receipt that shows the customer what they paid.

Are you actually based in Texas?

What does the sales tax setup look like for a Texas restaurant?

6.25% state, plus local rates up to 2%, for a maximum of 8.25%. Mixed beverage taxes are separate and have to be configured as their own item class, which is the piece generic POS setups most often get wrong.
